Pick of the Litter Official Rules

ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

1. Eligibility: Subject to the additional restrictions below, the 2013 Four Corners Pick of the Litter Contest ("Contest") is sponsored by The Durango Herald and Cortez Journal ("Sponsor") and is open to residents of La Plata and Montezuma Counties.  Participants must be 18 years or older at the time of entry.  Employees of The Durango Herald, Cortez Journal, and each of their respective affiliated companies, advertising and promotional agencies, and the immediate family members of or any persons domiciled with said employees, are not eligible to win.
2. Contest Period: Contest period begins at 12:01AM January 1, 2013 and ends at 5:00PM February 13, 2013.  Winners will be announced on or about February 17, 2013.
3. How to Enter: 
a: Online entries: Beginning at 12:01AM January 1, 2013 and ending at 5:00PM January 16, 2013, entries may be submitted by completing the online entry form, uploading a photo of your pet, submitting the requested $10.00 entry donation (credit card preferred), and filling in any other required fields, then clicking on the "SUBMIT" button.  Entries may be submitted by the owner or adult who is 18 years or older at the time of submission.  Digital photos should be in jpg or tif format and 300dpi resolution.  Most digital photos taken in the fine to superfine camera setting will be fine.  Poor quality photos will not be accepted.  Only one pet per photo and one photo per submission.  One registered entrant may submit up to 5 entries, each with its own $10.00 entry donation.  Owner's name, phone number, and pet's name must be included with all entries.  Those entries with incomplete or incorrect information will not be accepted.  Sponsor reserves the right to refuse any photograph it determines to be unacceptable.  Submitting this information, the photo, and an entry form serves as a release for The Durango Herald and the Cortez Journal to use your pet's name and photo in newspapers, on its web sites, and in future promotional advertising.  Checks for entry fee must be made payable to The Durango Herald.  All photos become property of The Durango Herald and will not be returned.  Copyrighted photos must be accompanied by a photographer's release.  To submit online, your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking.  Submissions must be received by 5:00PM January 16, 2013.
b. Mail and In-person entries: To enter by mail or in person, complete the entry form available in The Durango Herald, Cortez Journal, The Mancos Times, and The Dolores Star during the entry period and available every day at The Durango Herald office located at 1275 Main Ave, Durango, CO , and the Cortez Journal office located at 123 Roger Smith Ave, Cortez, CO.  Photos must be at least 3" by 5" and as high quality as possible.  Sponsor reserves the right to refuse any photograph it determines to be unacceptable.  Checks for entry donation must be made out to The Durango Herald.  The entry form with the photo and $10.00 entry donation can be mailed or dropped off to:

Office hours are 8:00AM-5:00PM, Monday through Friday.  In-person and mailed entries must be received by 5:00PM January 16, 2013. Photocopies of the entry form are not permitted.

By submitting an entry form in-person or through the mail, you authorize The Durango Herald staff to register you and submit your photo online at www.durangoherald.com/PickoftheLitter. 

Photos may appear a minimum of once in the newspaper, but will remain online even as new photos are posted and throughout the voting period.  Positioning of the photos will be determined solely by Sponsor.
4. Voting Procedures and Rules:
a. No purchase necessary; ballots will be available at The Durango Herald reception desk from 8:00am to 5:00pm, Monday through Friday, beginning January 20, or by request through mail.  The voting period will begin at 12:01AM January 20, 2013, and conclude at 5:00PM February 13, 2013, consisting of three voting periods.  At the close of each period, some entrants will be eliminated.  Votes may be made in person, mailed, or submitted online.  Voting is open to the general public.  Online voting is limited to persons 18 years of age or older.  Vote for your favorite pet by submitting a voting ballot along with a suggested $0.50 per vote donation to the Newspapers in Education Program and the La Plata County Humane Society.  Each donation will count as one vote.  There is no limit on donation amounts or votes.  No donations will be refunded.  See below for details on online and mail/in-person voting.
b. Online Voting: To vote online, go to the "Vote" tab on the Pick of the Litter website.  You must register to vote.  Only one registered account per voter.  If multiple accounts are detected for a single voter, they will be disabled and disqualified.  Online voting will end at 5:00PM February 13, 2013.  Online voting is limited to persons 18 years of age or older.  Minimum contribution for online voting is $5.00 for each submitted ballot (10 votes).  Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking.  Ad blocking software on your computer needs to be disabled so that it doesn't interfere with processing your entry.

Hand delivered original ballots will be accepted at The Durango Herald or Cortez Journal offices.  Office hours are 8:00AM to 5:00PM Monday through Friday.  Mailed and in-person votes must be received on or before 5:00PM February 13, 2013.

Each original ballot counts as one free vote.  You can vote without making a donation by submitting one original ballot in person between the hours of 2:00PM and 4:00PM in person to either The Durango Herald or Cortez Journal office.  Each ballot will be counted as one vote.  Ballots without a donation are limited to one vote per ballot per day per envelope.

ONLY ONE ORIGINAL BALLOT PER PERSON PER DAY PER ENVELOPE.  Sponsor will neither accept more than 10 original ballots from one individual nor more than one original ballot per day from any individual.  No facsimiles or mechanical reproductions are permitted.

Sponsor will not be responsible for incomplete, lost, late, postage-due, misdirected, or illegible entries (either photos or ballots) or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware, or software, whether originating with sender or Sponsor.  In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent.  For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider, or other organization responsible for assigning ISP addresses for the domain associated with such ISP account.  All entries become property of Sponsor and none will be returned.

Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.
5. Winner Selection: One grand-prize winner, one second-place winner, and one third-placd winner will be selected.  Winners will be determined by total number of eligible entries and votes received.  In the event of a tie, Sponsor will randomly pick the winner from the tied entries.  Winners will be selected on or about February 14, 2013.
6. Winner notification and acceptance: Winners will be notified on or about February 15, 2013, at the telephone number provided on the winner's entry form.  Sponsor will call during regular business hours.  Failure to reach winner during regular business hours by phone may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries.  Winners may waive their right to receive prizes.  Prizes are non-assignable and nontransferable.  No substitutions are allowed by winner.  Sponsor reserves the right to substitute any prize with another prize of equal or greater value.  Prizes and individual components of prize packages are subject to availability.  Owners of winners are solely responsible for reporting and payment of any taxes on prizes.

Owners of winners may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law) which must be returned within five (5) days of date of personal delivery or date of postmark.  Failure to sign and return the affidavit or release within five (5) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner.  Except where prohibited, acceptance of any prize constitutes winner's owner's consent to the publication of his or her pet and likeness in any media for any commercial or promotional purpose, without limitation.  Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
7. Participation: By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor.  Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of Contest as solely determined by Sponsor.  In the event that Contest is compromised by a virus, non-authorized human intervention, tampering, or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness, or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify, or terminate the Pick of the Litter Contest.  Should Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the determination date.
8. Construction: The invalidity or unenforceability of any provision of these rules shall not effect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
9. Sponsor: The Pick of the Litter Contest is sponsored by The Durango Herald  and the Cortez Journal.  Pick of the Litter proceeds benefit the Newspapers in Education Program and the La Plata County Humane Society.  the decisions of Sponsor regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects.  Sponsor will not be responsible for typographical, printing, or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
